Terms of use geberit campus
1 General information
1.1 Geberit Pty. Ltd (“Geberit”) offers its business customers, their employees and other prospective parties a free, web-based online platform through which they can independently select and book Geberit courses (“Geberit Campus”). A selection of eLearning programmes and webcasts can currently be booked via the Geberit Campus (“Course(s)”).
1.2 The following Terms of Use shall apply exclusively to the use of the Geberit Campus. Any conflicting contractual conditions shall not become part of the contract, even if Geberit does not expressly object to them. Geberit reserves the right to amend the Terms of Use at any time and without stating its reasons. If the Terms of Use are amended, Geberit shall inform you of this in good time. Use of the Geberit Campus is not possible without acceptance of the Terms of Use.
2 Access and booking
2.1 Geberit Campus can be accessed via standard end devices (PC, laptop, smartphone) using a web browser (please modify URL https://www.geberit.com.au/). The web browsers Microsoft Edge, Mozilla Firefox, Google Chrome and Safari are all supported in their current versions.
2.2 Gaining access to Geberit Campus, as well as finding information about current Geberit courses, viewing course details and registering for a course, are possible and permitted after registration with a Geberit ID by a person of legal age (“User”).
2.3 Once logged in, the user has access to a dashboard that displays all the courses he has booked for himself and for other participants, along with the associated certificates of participation (“Overview”), as well as to a catalogue that provides an overview of all the courses offered by Geberit (“Seminar catalogue”).
2.4 In addition to himself, the user can also register other persons (“participants”) in the seminar catalogue area for one or more courses. To do this, he must fill in the participant information for the selected course and confirm the registration by clicking the “Book now” button. The minimum age for participants is 16 years.
2.5 Before registering participants, the user is obligated to ascertain their permissible minimum age, to forward to them Geberit’s Terms of Use and data protection information, and to obtain their data protection-compliant consent to data processing by Geberit. The user is obligated to provide evidence thereof (e.g. by written confirmation from the participants), and must submit this to Geberit on request. He shall confirm this at the end of the registration process by ticking the corresponding check box. The user hereby obligates all participants registered by him to comply with the specifications in these Terms of Use.
2.6 Upon successful registration, the user shall receive a confirmation pertaining to receipt of his course request, as well as a listing of the registered participants by email. Participants will also receive a course confirmation and a link to the course with individual access data. If the course does not take place, or if participation is not possible for other reasons, the user – as well as the participants – will receive a course cancellation notice. The email sent to the participants will contain the name of the user through whom the registration was made.
3 Dashboard
3.1 Geberit Campus shall provide the user with a dashboard that affords him the opportunity to maintain an overview the course progress of all participants registered by the user. In addition to the date and name of the booked course, the course progress of the individual participants can also be viewed. There is also the possibility for participants to download a certificate of attendance following successful participation.
3.2 Participants themselves do not have access to the dashboard, but can view their own course progress via their access data and download their participation certificate upon successful participation.
4 Logout / Deletion of the user account
4.1 The user and the participants may terminate the use of Geberit Campus at any time or log out of Geberit Campus by clicking on the “Logout” button.
4.2 If the user also wishes to have his personal data or the personal data of the participants deleted, he may send an email with a request for deletion to the following address: dataprotection@geberit.com. The user shall receive an email confirmation of the deletion or, if deletion is not possible, a notification of the reasons for the impossibility of deletion.
4.3 In the event of a request for deletion, the user shall be obligated to obtain the consent of all participants that their data be deleted, and to confirm this vis-a-vis Geberit. The user shall inform the participants of any notifications from Geberit to the user, which also affect participants.
4.4 Participants can also request deletion of their data via the above email address. In such a case, the communication process described in 4.2 shall take place directly with the participant.
5 Scope and limitations of the Geberit Campus
5.1 Geberit strives to ensure the high-level availability of the Geberit Campus. Despite our best efforts, we cannot guarantee or warrant that all courses will be available at all times. An impairment of availability may result, in particular, from general disruptions affecting the Internet, or due to the performance of maintenance work. Geberit may also remove (or temporarily suspend) courses from the Geberit Campus at short notice. Geberit shall inform all users booked on the affected courses in a separate communication. Users are obligated to inform all participants booked by them on the courses concerned accordingly.
5.2 There shall be no claim to the compatibility, availability or unimpeded functioning of Geberit Campus. It shall be the responsibility of the users and participants to create the technical conditions for access to the courses. Geberit shall not assume any costs for establishing these prerequisites. This shall also apply in the event of amended technical requirements due to further developments of the Geberit Campus.
6 Security
6.1 All measures that could endanger the security and stability of the Geberit Campus (or its courses) must be refrained from. This includes, in particular, knowingly interfering with the software and transmitting viruses, Trojans or other forms of malware;
6.2 No laws, ordinances or other legal norms are to be violated while using the Geberit Campus;
6.3 The access data is only valid for the user or participant. The Geberit ID and other access data must always be kept secret, it must not be passed on to unauthorised third parties and must be protected against access by third parties by means of suitable measures, in accordance with the latest technological standards.
6.4 In the event of violations of this Clause 6, Geberit shall be entitled to block access to Geberit Campus and the Geberit ID.
7 Liability
The assertion of claims for damages against Geberit is excluded unless they are based on intent or gross negligence on the part of Geberit, its legal representatives or vicarious agents. Geberit shall also be liable for claims for damages arising from injury to life, limb or health, as well as a breach of material contractual rights and obligations (so-called “cardinal obligations”) in the event of simple negligence.
8 Copyright and rights of use
8.1 The contents provided by Geberit are subject to protection by copyright. Geberit hereby reserves all rights resulting from this, in particular, the right of reproduction. Users and participants shall not receive any exploitation rights to the content or programmes provided.
8.2 Any learning content retrieved during course participation may only be used for a person’s own learning purposes. Any commercial transfer – in particular, the sale, rental or lending of courses, their contents or documents – is not permitted. The reproduction of course material for private (and other own) use is possible.
8.3 Recording of the courses is not permitted.
8.4 Trademarks, company logos, other marks or endorsements may not be used, removed or altered.
